TYPES OF ALIMONY
Maryland’s equal rights amendment exposes both the husband and wife to the possibility of being required to pay alimony (also called spousal support) both before and after adivorce. There are three types of alimony/spousal support in Maryland:
Alimony while the parties are in litigation awaiting the final divorce trial — This is also called ” alimony pendente lite.” A court can award this type of alimony from the time you file for divorce and the time the divorce is finally granted. The goal of this type of support is to maintain the status quo until a settlement is reached or until the divorce is finalized.
Indefinite alimony after the divorce — This is a type of alimony that is awarded for an indefinite period of time. It is generally awarded when the recipient cannot support himself or herself because of age, illness, disability or the inability to make reasonable progress toward becoming self-supporting.
Rehabilitative alimony after the divorce — This is the favored form of support. It is awarded for a finite period of time and its purpose is to give the recipient a sufficient amount of time to obtain or restore the necessary skills or education to become self-supporting. However, if after the recipient has made as much progress as he or she can, but is still unable to support himself or herself, a request to extend the award of alimony must be filed with the court before the original award expires.
