How Maryland Child Support Is Determined

While every situation is different, there is a basic formula used to determine child support in Maryland. This formula takes into consideration the incomes of both parents, their child-related expenses, and the time they parent the child or children. Typically, the noncustodial parent will pay child support to the custodial parent. If a child spends 28% or more of their overnights with a parent, this will affect the support. This formula is based on the Maryland Child Support Guidelines.

Unless there is cause to do so, the court rarely strays from following the guidelines. Extenuating circumstances however can be cause for a deviation. Imputed income is a term used by the court to determine the amount of income a parent could be making if they chose to work.
